I understand that you have some questions about iCloud and your iPhone 4. Let's see if we can clear this up for you
To answer your question about your iPhone 4 being useless, the answer is no. Now your iPhone is at its latest version of iOS and can still use iCloud, but just not all of the features. For example, you can use the Fine My iPhone feature, but can't use the app as it requires iOS 8. To do that, you can use iCloud.com or your 5th Generation iPod touch. Take a look at the article below and look over the table for exactly what you are trying to sync over.

Based on the table, your contacts still work and will sync across your devices as long as you are signed in with iCloud. As far as your photos, you would not be able to use iCloud Photo Library but could set up an iCloud Photo Sharing album to keep those images in sync.
