I understand that you would like to get your Notes to create a checklist. What that sounds like is that your version of Notes is not updated. I would make sure that you are running iOS 9 and have upgraded the Notes app. Take a look at the article below to for more information on the new version of Notes with iOS 9.

The problem is that I have upgraded to IOS9 on both phone and pad but because I am still using an Ipad2, the software can't create Notes with Checklists d yet if created on the phone and sync'd, it can continue creating Checklists on the Ipad. As I said, it is stupid

If you don't see the option to create a check list, then ensure that Notes was upgraded would have been it. But as you said, it is all upgraded. The next best thing is to contact Apple Support to further look into this.

Basically, swipe up on the top of the keyboard to expose additional editing options, including checklists.
