When the phone is purchased, you have the ability to purchase Apple Care Plus, which extends the warranty for an additional 1-year. However, that has to be purchased within the first 30 days. You can make an appointment at the Genius Bar to have the phone examined and see if there is a problem with the GPS receiver in your device. That is free of charge. Should there be something wrong with the device, since it is out of warranty, you would be responsible. Apple does provide an out of warranty replacement, which costs significantly less than a new phone. If the GPS was failing in September, why did you not see about it being inspected then, as it would seem the device would have been under warranty at that time, given your report that you have had it for 15 months now (January).
The decision to switch to another brand would be yours to make.
I'm not sure what searching you have done that would convince you Apple is in store for a lawsuit, but then given the litigious attitude of the American people, anything is possible. The question is, as always, will it be successful.
