This feature is off by default in new installations of OS X, as was the case in my clean install of El Capitan, and subsequent updates through 10.11.3.

Try logging out, and then back in again. If that has no effect on disabling the setting, then shutdown, and boot again. I did not need to do either of these steps.

Mac App StoreYou might be in Full Screen Mode, place the cursor at the top of the screen and when the menubar appears click on the green button
this should return you to 'normal' screen mode and the menubar should display as long as that button in system preferences is unchecked.
