If the new update is not available and your screen says, "iOS 9.2.1 your software is up-to-date," then Apple has pulled back the iOS 9.3 update because some users were experiencing problems when they were completing set up. If you are updating your iPod touch using iTunes try: Connect your iPod to your computer. When iPod is connected and iTunes is open, click on your device. Then click on the summary tab. Scroll down and click "check for updates." If a dialogue box pops up saying "This version of the iPod software (9.2.1) is the current version. iTunes will automatically check for an update again on etc." Then that means you will have to wait until Apple releases the fixed version of iOS 9.3.
