No one here can guarantee anything, Apple does not guarantee anything either, they have a manufacturer's warranty. You need to troubleshoot your device. User troubleshooting steps are restart, reset, restore from backup, restore to factory, testing after each step. See the following support documents for troubleshooting steps.

Brand new iPods purchased from Apple or an authorized reseller have a one-year warranty (for manufacturing defects). I have a collection of iPods and they do not "freeze."
