Is there a way to turn on find my ipod touch with out actually having the device?

    Yes. Log into www.icloud.com, sign in with the Apple ID credentials you used on the phone and turn it off from there.

    No, if FindMyiPod is not turned on in Settings>iCloud the only way to turn it on it to have the device in hand and enter the Pass and turn it on.

    Without it turned on it is not identified to any person/ID so there is no way to communicate with it.
