Return it for a refund, if you can, or take it to an Apple store for an exchange provided they will help you.

Try holding the home and sleep/wake button while the phone is plugged into a Mac (or PC) with iTunes installed. iTunes will prompt you asking if you would like to "reset" the device. Proceed with the process. Tell me what the end result is

Next time, you might want to make sure you'll actually be able to use the phone before buying one.
