Upgrade to OS X El Capitan - Apple Support
When you see that dialog at the App Store, it could be that Apple servers are busy. When they say please try again later, that's what you need to do.

Disable anti virus software if installed then try downloading El Capitan.
Apple system status is all green so it's not that > https://www.apple.com/support/systemstatus/

Aug 31, 2016 3:57 AM in response to epifromprby Barney-15E,Try going into the App Store and access your Account info. Go through the sections and make sure credit card info is valid and agree to any new user agreements that pop up.
There have been times in the past when stuff like that would produce spurious error messages.

As per these instructions:
“Add a device to the list
After you sign in on a device with your Apple ID, that device appears in the list. Here's where you need to sign in:
- For iOS 9, sign in to iCloud, iMessage, FaceTime, the iTunes and App Store, or Game Center on the device. You can also see your paired Apple Watch.
- For iOS 8 sign in to iCloud or the iTunes and App Store on the device. You can also see your paired Apple Watch.
- For OS X Yosemite and later or Windows 10 and later, sign in to iCloud on the device.
- For tvOS 7 or later, sign in to the iTunes and App Store on the device.
- If any of your devices are using earlier versions of iOS, OS X, or tvOS, you won’t see them in your device list. “
I go to System Preferences to sign in to iCloud; what I have is something else! Mobile me
So, my Macbook pro is not defined in the account. Next steps?
I found that i can upgrade in steps; but then again I need the Apps Store which is not working; I am frustrated with this problem

If that doesn't work, try downloading and installing the 10.6.8 combo update: Mac OS X 10.6.8 Update Combo v1.1
