Q: I lost my iPod. You could call it stolen..?

So I went to Six Flags on August 30 and it was great! I brought my iPod along to take pictures, putting it in airplane mode to save battery. It does not have a passcode!
One of the rides we went on was the Raging River. When I saw that the people finishing the ride were absolutely soaked, I decided I didn't want to risk my iPod getting wet. There was a little shelf/cubby next to the man conducting the ride where people put their belongings while they go on the ride. My friend said I could put my iPod in his green bag, so I did. Little did I know that it was the wrong bag!
A little after we finished the ride, I asked for my iPod back and we couldn't find it. Then I remembered I put it in an olive green bag with orange lining. It looked similar to my friend's backpack, but it wasn't the same. I spent the whole day worrying, keeping my eyes peeled for olive green bags. We checked the lost and found a few times but it wasn't there. You'd think that people would check their bags.. Finally we had to leave.
When I got home the first thing I did was go on Apple to find out how I could find my iPod. There's a thing in iCloud called Find Your iPhone/iPod/iPad/Mac. It said that my Find Your iPod was not enabled, but I swear it was the last time I checked. I went on the Six Flags lost and found page and filled out my missing report.
What really worries me is that it doesn't have a passcode. Whoever has it doesn't seem like they're going to return it. All they have to do is reset it and they have a new, free iPod! Or instead of resetting it, they can go through all my pictures and personal stuff on there. They could text my friends!
Help? Please?

You can try placing the iPod in Lost Mode or even try erase it if FIndMyiPod was turned on in Settings>iCloud

If you place it in Lost mode it will be locked the next time it connects to the internet.
If you have a 5G or later iPod and FIndMyiPod is on no will be able to activate the iPod if they try to Restore the Device.
