If you're using an iPhone 5, you should be able to update your device to iOS 10. I see from your post that your device is showing iOS 9.3.5 as the most current version. I know it's important to have access to this update, so I'm glad to assist. Have you tried restarting your iPhone as a first step? Take a look at this website for more information:

If the issue persists after you restart, try updating your device using iTunes instead. Take a look at the following website, particularly the section titled "Update your device using iTunes":
