I understand that you're looking to install El Capitan on a MacBook Pro that you've just purchased. Take a look at the following information that we have published on the subject:
How to get El Capitan
Now that macOS Sierra is available, you should upgrade to Sierra instead of El Capitan.
- If your Mac doesn't support Sierra, or you're using Snow Leopard and would like to upgrade to Sierra, you can get El Capitan from the App Store.
- If you downloaded El Capitan from the App Store before Sierra became available, you can still reinstall El Capitan from the App Store.

Oct 2, 2016 4:11 PM in response to TomBuyvoetsby OGELTHORPE,Until you install the original OSX that came with your MBP, you will only be able to update applications using the prior owners Apple ID and password. The MBP is associated with the prior owners Apple ID.
By erasing the HDD and installing the original OSX, then your Apple ID will be associated with the MBP and then you will be able to update applications and install newer OSX's.
A 15" mid 2009 came either with Leopard or Snow Leopard as the original OSX. You can use this disk to install Snow Leopard:

After you have installed the above OSX, you will have to run the Snow Leopard combo update:

After this, El Capitan will then meet the requirements and be available for installation.
