The worst part is that I can't tell which of those have been partially watched (in the list itself in iTunes, and especially not on our AppleTV).
I'm thinking that this is something that Apple will have to enable for us (or at least someone smarter than I am).

There is no criterion in a Smart Playlist that will allow you to select partially watched movies. If you wish to make a suggestion to Apple, you can do so via the feedback page:

I've also suggested the ability of Sri on AppleTV be able to search my networked iTunes library for music and movies.
My music collection is modest at 15300+ songs. Plus I have just under 2000 movies which I own on DVD and spent the time converting and adding to iTunes. Being able to search for actors or what's in the description would be really nice... Heck. just being able to jump to movies starting with T without making a smart playlist would be nice (which we CAN do in iTunes, but not in connected computers on AppleTV).
If Netflix can remember where we are in what we're watching - even after more than a year, why can't Apple add that function to iTunes?
