Chess says Draw when it's not!!!

So, the computer really doesn't like to lose. Notice that the black king can take my knight, or move to E7. Why does it say that the game is a draw?

Is this the third time this position occurred in the game, or have fifty moves passed since the last capture or pawn move? In these cases a player can claim a draw without the consent of the other player.

The very first time. I play chess a lot and have seen this "bug" often (at least 4 times) in Apple's version.
