Why my "BRAND NEW" unactivated iphone got warranty.

I just bought the new iphone from the ebay. The seller claim that this phone is the "BRAND NEW NEVER USED" one. However, the overall condition look suspicious. Then I try to check the serial number thru "Online Service Assistant" of apple ( https://selfsolve.apple.com/GetWarranty.do ) . It showed as follow :-

*Warranty information about your iPhone*

Our records indicate that your product is covered under Apple's Limited Warranty which is estimated to expire on Sep 21, 2008.


Your product is eligible for complimentary phone support which is estimated to expire on Sep 21, 2008.


If you believe that this information is inaccurate, learn how to update your coverage status. Please put your sales receipt in a safe place. You will need it for warranty validation.

Extend your service and support coverage for your product with the AppleCare Protection Plan. If you have already purchased an AppleCare Protection Plan, make sure you have registered it.

I wonder why I just bought this iphone but it answered like this. Then I check the IMEI number on the box with the phone itself I found that it wasn't similar !

I check the serial number on the box (not on the phone) thru online service assistant again. It showed as follow :-

Our records indicate that this product has been replaced. Please provide your product's replacement serial number to find its support and warranty coverage information. For more information, please contact us.

So Can it be concluded that the phone I got is the used one that may have some defect that have been claimed with apple.

How can I manage with this problem. Report this bad manner of this seller to ebay and paypal and refund the money back, can be?

If you live in the U.S., why would you purchase what is claimed by a seller on eBay to be a new iPhone when you can purchase a new iPhone from Apple or at&t?

The warranty period begins on the purchase date from Apple or at&t.

Unless this iPhone was purchased from the seller as unlocked to be used with another provider, or you plan on unlocking this iPhone - with either one not authorized by Apple, is against the license agreement, and voids the warranty, you don't have a warranty.
