I'm really hoping that someone out there has an answer for this one. I just bought an ipod nano yesterday and excitedly added songs today, however, I discovered that I can't change the volume level. I can play the songs and adjust the scroll bar in the volume control screen but the volume does not change at all. I've searched various forums for volume control solutions but the only topic I can find involves setting the maximum volume control, I can't find any answers to simply being able to change the volume on a currently playing song. I even tried restoring my ipod, that didn't fix the problem. I'd really appreciate any suggestions you might have!
ipod nano, 3rd generation,
Windows XP,
8GB version
I had the exact same thing happen on my 2 day old nano! Using the scroll wheel to adjust the volume only resulted in the volume (and volume bar) going down for a sec and then going right back up to the orginal volume. I reset my nano and it seems to have solved the problem.
To reset your iPod:
1. Toggle the Hold switch on and off. (Slide it to Hold, then turn it off again.)
2. Press and hold the Menu and Select buttons until the Apple logo appears, about 6 to 10 seconds. You may need to repeat this step.

I just got back from the Apple store. They ran full diagnostics but cannot find the cause of the stuck volume. It appears to be a hard fault and not software. Their advice was to "take it back to where you got it and get a new one."
I just got my nano and have the same problem. The volume is set at one level and does not change. Using the scroll wheel only shows that the volume bar on the display changes, but no actual change in volume. I have reset, restored the nano to no avail. The volume lock is not engaged. I only get one, preset volume level. Apple tech support just said to send it back under warranty.
So when a song is playing, you scroll your finger around the wheel and the volume bar moves upwards on the screen but the actual volume you can hear does not change? Does it change at all, i.e. can you reduce the volume or is it just fixed at the same level all the time?
Resetting or restoring the ipod nano does not work. The volume has never changed, not even the initial volume dip you reported. The display bar for the volume is the only thing that changes.
I have reset, restored and even called it ugly names, but it is not responding.
