We don't deal with Apple's market research here on the help forum. Guessing what Apple is aware of or what they are doing about an issue is speculation. In order to make sure your issue is brought to Apple's attention you need to fill out one of their feedback forms:

I don't see a specific form for the mouse, but you could probably just choose the type of Mac you are using and file a detailed report listing the problems you are having and what you are using your mouse to do (I'm sure graphic artists use a mouse quite differently than a musician).
Like I said, the Mighty Mouse does require holding and moving the mouse in ways that are different from most other mice. Some people love it, others change to 3rd party mice that may work in a more familiar way or have even more features and buttons, others just go get the mouse they were using with a PC. Some users should not be using a mouse at all for production work, as is the case of graphic artists who should invest in a nice pressure sensitive tablet. No product can be the best for everybody but you have an almost unlimited choice of substitutes.
