Apple TV, No NBC tv shows, No Heros and on The CW no Smallville, why?

I recently purchased Apple TV to catch the shows I miss while at grad school at night.

I've noticed NBC doesn't have any shows. That means no Heros. Also The CW channel has all their shows except for Smallville.

Anybody know the deal with why these shows aren't available on Apple TV / Itunes?

Is Apple trying to work out a deal? Perhaps I should have gotten TIVO instead.
