New Apple In Ear Headphones disabling volume control on MBP

Every time I use my new in ear headphones from apple with my MBP the volume buttons on the computer stop working as well as the slider control in the top right, i can change volume by going into system preferences and to the audio tab but the other ways dont work until I restart my MBP without the headphones. I know the remote/mic on the headphones does not work with the MBP but it should not disable the computers methods of controling volume. this is not a major issue mainly just an inconvience but I thought I would put it out there and see if anyone else has this problem.
