I haven't noticed this issue before. You can make a reservation with a Genius at a local Apple retail store here: http://www.apple.com/uk/retail/geniusbar/
The Genius will take a look at the iPhone and repair/replace it if needed.

Same here, not on the top but somewhere along the left side. I have already checked other 3GS and most of them have an area where the gasket is not in contact with the glass edge.MacBook C2D 2.2GHz 4 GB RAM, Mac OS X (10.5.5)
