When syncing smart playlists that have the 'Live Updating' option enabled, the playlist that ends up on the iPhone with OS 3.1 or Touch with 3.1.1 does not match what shows up in iTunes. The temporary workaround is to disable the Live Updating option. That has terrible side effects though. But does anyone know if Apple is considering this a bug, or some kind of 'new feature'?

A solution to this would be very nice because I use my smart playlists regularly on my iPod Touch
I have the same trouble. It really costs me headaches. Without live updating i have to maually add new songs to that list, right?

Without liveupdating, the smart playlist would not update automatically as your library change, it will create a playlist automatically when created, and remain as a static playlist, until you do a refresh.
I'm having the same problem. I only use my iPod for podcast, I normally refresh, sync, and go. My smart playlist with updating takes care of everything. But it broke with the iTunes v9 release.

The playlist also doesn't update on my ipod. I have a playlist for songs that haven't been played in the last 20 days. When I have my ipod connected to my computer, after the song plays, it is removed from the playlist. That is not the case when my ipod is not connected. I also have the problem where the playlist is one way in iTunes, but very different on my ipod.This is very frustrating. Any idea when they will have this fixed?

A work around that I have found is to delete the smart list, recreate it through iTunes 9 and then make sure to sync it that day. For instance, if I sync it the night before, the list will be off and won't update properly. I have to sync it before going to work. It's it's graceful, but seems to be working for now.

I can reproduce this on the Nano 5G. But to make things more annoying, if I view the smart playlist on my Nano via iTunes 9, it appears that all the content is there.
Yet when I enter that playlist in the pod, it's not.

It's even worse. My nano 5th gen crashes when syncing a smart playlist with activated Live Updating!

I am having the exact same problem. I tried re-syncing and erasing and remaking the playlists but nothing worked. I am using the temporary workaround by disabling live update. I hope Apple comes out with a fix for this.
Me too, on my iPod touch. I swear I remember this happening before a long time ago. I knew right away disabling live update was going to fix it like before.
9.0.1 doesn't fix this issue! come on Apple! Are you going to try and convince me this is a 'feature'? Fix this issue!

I've got the same problem! Driving me nuts. I've got a smart playlist to show the top 10 most often played songs that have been played in the last week. It live-updates just fine in iTunes, but doesn't sync to my 5G nano. The playlist shows up, but with a totally different set of songs. Apple should really get on this!
