There is a known bug with the Touch/ iPhone 3.1.x OS such that the sort order (and contents) you see in the iTunes version of a playlist does not match what you see on the Touch/ iPhone.

If you're sure that you've saved the desired sort order in iTunes and it is not syncing to the Touch in the same order, then the workaround is to edit the smart playlist by adding the criteria "Playlist -- Is -- Music", where Music is the general folder for music items in your iTunes library.

This is a very useful tip for incorrectly synching Playlists (wrong content, not in the order listed on iTunes, etc.). It's a temporary work-around until Apple fix this bug, but it does work and simply involves deselecting 'Live Updating' in Smart Playlists before manually dragging the list back to the Touch:

It appears there's a bug in iTunes 9 and I wonder if this is also causing the issue with ratings.

Hope this helps.
