My ipod Touch doesn't work on one side of the sceen

Basics from the manual are restart, reset, restore.

hi i just got my ipod touch bout 5 days ago..the left part of the screen makes a screeching cracking sound when i touch it ..the right side is normal..before i bought one..i checked with display units from stores..like best buy..frys..apple store..and all the glass screen were in good fit..mine is not..i bought it online at ebay..it was a bnew sealed unit..should i take it to apple and have it repaired? the sound is very annoying..it is like glass rubbing glass..does this qualify to have my unit replaced?
