Can't constrain to portrait mode when cropping

I'm trying to constrain some landscape picture to portrait, using the drop down menu that appears in the cropping tool. All of the other presets are clickable apart from the constrain as portrait or landscape options.

Why is this? It happens regardless of whether I set the 'constrain' checkbox to on or off.

Please help as this is very annoying!

MBP 13", Mac OS X (10.6.3)

For these options to be available you need to first select a Cropping Ratio, then you can decide if you want it oriented as landscape or Portrait. So, choose, say 4 x 6 (Postcard) and the option is available - choosing Constrain As Protrait will give you a 6 x 4 ratio instead of 6 x4. The option is not available will all options: for instance 16 x 9 HD can only be saved as Landscape, as that's a pre-defined ratio for using with specific circumstances.
