Activate old iPhone without the data plan

If I gave my old iphone (3GS) to a friend of mine and he already has an ATT wireless voice only account will he be able to activate the iPhone without the data plan? He doesn't want to access the internet or get emails over the cellular network - he'll do that over wifi.

No, he'll have to sign up for a dataplan to use the iPhone, even as a phone only. He could sign up for the minimum plan, which is only $15/month. At least we have that option now.

AT&T requires a data plan with ALL iPhones. When activating, the IMEI of the phone is transmitted and identifies it as an iPhone.
