Misleading Stores Selling 3rd Gen 8GB iPod Touch

I feel both stupid and frustrated. I purchased a brand new in box 8GB iPod Touch from a guy on eBay. He advertised the item as a "3rd Generation iPod Touch". I was super excited to get it. Once it arrived I played it with for days and decided to check out the support information on the unit. I typed in the serial number on Apple's website and waddya know? The website says that it's a 2nd Generation! I complained and complained to the eBay seller telling him that he sold be an outdated and old unit and I wanted a refund. He accepted my return and refunded my money.

I decided to go with a more reputable reseller like MacMall.com. They too advertise a "8GB iPod Touch (3rd Generation)" as you can see right here: http://www.macmall.com/p/Apple-Consumer-Electronics/product~dpno~7922866~pdp.fhf ijcd

I didn't even open the box yet until I checked the serial number. BAM, another 2nd Generation iPod Touch. I called Apple and they told me "DUH, we never even made an 8GB 3rd Gen model!" and of course I verified this by looking right on the Apple store.

So why are all these companies including MacMall.com giving people bogus information about 8GB 3rd Generation units? Is there something I don't know? Should I be angry? I don't really know at this point. I'm curious to hear other people's thoughts. Don't the 3rd generation units have better processors and general performance enhancements? That is why I was specifically looking for a 3rd gen. I simply have no need for a 32gb or 64gb model which is the only available 3rd gen units.

Your link is one that I've read a bunch of times. You'll see that the only 3rd Generation iPod Touches that are listed on that page are the 32GB and the 64GB models. The model number you posted belongs to a 32GB model.

There simply *is not* a 3rd Generation iPod Touch that is an 8GB model. However all these companies are misleading people saying that they're selling a 3rd Gen 8GB model. That is the point I'm trying to make. Although it is of my understanding that there isn't a difference in hardware that I'm aware of besides the storage capacity.

Companies like MacMall.com are saying it's a 3rd Gen because they don't want people to think it's old and outdated compared to the 32GB and 64GB models. I think this is a real problem.

By the way, I was able to confirm that there is not an 8GB 3rd Gen model simply by calling 1-800-APL-CARE and asking a representative.

My problem is that Apple claims that the 3rd Gen is almost 50% faster than the previous models. This is why a 3rd Gen model sounded attractive to me. If companies like MacMall.com are CLAIMING to sell 3rd Generation 8GB iPod Touches but in actuality it is the 2nd gen with inferior hardware, then that really bugs me..

I stand corrected. After much search on various web sites:

The hardware in the 8GB iPod Touch 3rd generation is actually the same as the 8GB iPod Touch 2nd generation. The only difference between the 2nd and 3rd gen for the 8GB model is the 3rd gen comes with the iPhone OS3 software.

iPhone OS 4 will work with this device, but it won't have multitasking.
