Essentially you bought a used "as-is" product from Fry's and as such, the manager should make an adjustment for you.
Or simply let you return the product for refund. Then take your business elsewhere; or look into Apple refurb product
page in the official Apple store online site. ~ On occasion, some official Apple store retail locations may also have their
own refurb products on site. These are as-new and qualify for the AppleCare extended warranty, as official refurbished.
An 'authorized reseller' of any product can choose to sell an old used product without saying, but ethics should be better.
And those re-selling used Apple should not pretend their stock is new when it's been sold & now is out of warranty. Also
note: a re-seller can claim to offer an 'in-house' warranty, that is not officially an Apple plan. And outside usual warranty.
You could try & check the serial number against AppleCare page to see if that's been previously sold or not.
