No it is not under warranty , but it is Industry defect so i am not responsible for it
That's an interesting argument, but one that seems to be based more on emotion than on any legal requirement to provide a remedy. Warranties are clearly marked as limited because they have limitations on time and scope. In general, parts carry no warranty for the end user. The assembler/seller has a warranty on the assembled product. I have heard of there being specific defects in parts where perhaps the assembler and manufacturer had a contract that required payment for such defects, but I'd be surprised if that's happened for whatever you're claiming is your experienced defect.
