Have you done a factory reset? Are you seeing an Activation Lock? If it wasn't set up with an ID, there shouldn't be a problem.

Do a backup and try a factory reset. Then restore from your backup.

Restore to Factory setting

Backup - Restore your device from an iCloud or iTunes backup
