Apple ID and password lost from previous owner, now what do I do ?

If it is activation locked the only person that can remove it is the original owner. If you aren't able to contact them and have them remove it then the iPhone is useless to you.

It’s definitely not legitimate. If it was easy to break there would be no reason for Apple to implement this anti-theft measure.
