What if you don’t know who the previous owner is and it ask for their Apple ID and password??

There is nothing you can do. If possible, contact the seller and get your money back. Without the AppleID password you can not disable activation lock thus cannot use that device yourself. Apple will not get involved with any issue between seller and buyer in a private party sale or exchange of personal property.
