My IPad Air will not update to the new IOS 13.1, is this iPad too old?

If your iPad Air is a 1st generation model ( A1474/75/76 ) then iOS 12.4.1 is as high as your iPad Air can go.

The 1st gen iPad Air is NOT eligible for the new iPadOS.

Maybe you don't have an Air 2 or newer.
