Can’t sing into previous owners account to log it out they say they don’t know the password

Previous owner don’t know there Apple ID password nor can they get into there email to recover it.. how do I delete it from my iPhone

You can't. Unless the previous owner can remove the phone from their account, the phone is useless. Ask for a refund.
