have an ipod touch given to me the previous owner no longer
Ipod was give to me. Former owner doesn't remember apple id or password. Kid quite using it when she got an iphone.

There is nothing you can do with the original owner using the ID and password to remove the Activation lock. If it was set up xorrectly it should be the same ID and password as for their iPhone. If not they can use the following to retrieve the ID and password. Find user ID: hhttps://iforgot.apple.com/appleid#!§ion=appleid
