Error 400 when trying to restore an iPod Touch

I have an iPod touch I would like to use. The battery has been dead for about 3 years. Upon fully charging it - it says the device is locked for 10923 days due to invalid passcode - I've never attempted

to unlock this touch device. This must be a bug, which is really horrible for Apple - even though I know the passcode this bug has permanently rendered the device scrap metal.

We don't have backups. OK to erase.

We put the device in the DFU mode.

Upon clicking on "Restore" in iTunes - it says it will download iOS 3.1.3. Shortly after that we get an Error 400 "Unknown error" It appears Apple has removed this from their site.

Please advise how I can restore this back to factory settings. Is there somewhere else I can get the iPod iOS? I believe it is ether a first or second generation device.

I just came home from the apple store. The Genius bar tried to restore it on a MacBook. Same issue - after you accept the EULA - it says it is downloading iOS 3.1.2 and then the error 400 dialog box comes up.

Why can't apple just give me a download location? I tried looking online for a signed iOS for the iPod Touch and couldn't find it.

So now my device is permanently bricked and according to apple I should just get a new ipod.
