I have updated to the iOS 13 but still can’t have the dark mode and features
Your phone is using iOS 12.3.1, thus no Dark mode. Follow the instructions from your initial screenshots: complete iCloud Backup, and install iOS 13.

Your second screenshot indicates you do not have iOS 13.3 installed.
Please check Settings - General - About - Version = ???
