My old was not backed up and i got a new one and signed in to with my same Apple ID and i don’t have any of my pictures

No, not unless ...

1. you downloaded them to a computer from which you could sync them back onto the new phone
2. or if you were using iCloud Photos in which case enabling the setting on the new phone would allow them to download from the cloud.

Does either apply to your situation? If not, the photos are gone.

First of all, that only works if you were already using iCloud Photos. I mean no offense by this, but chances are, if you have to ask how to do it, you weren’t using it.
