how can I get my old photos onto my new phone from the icloud?

If you had iCloud Photos turned on in the old device, all you need to do is turn it on in the new device. See: Set up and use iCloud Photos - Apple Support

If you didn't have iCloud Photos turned on in the old device (or even if you did and want to migrate other things), see: Transfer data from your previous iOS device to your new iPhone, iPad, or iPod touch - Apple Support
