Can I update to 12.4.4 if so how

Can I update a new iPhone XS from current 12.3 to 12.4.4? I want to because I backed up a iPhone 6 with 12.4.4 and am trying to restore to my new XS but it has 12.3 and will not restore without a update software. The only one currently available it 13.3 and the XS gives me a failure to update notice and stops. Tried phone to phone and iTunes multiple times no luck even as a new setup. Anyone know how I can restore or up date the ios
