Did you ask for an unlocked phone when you made your purchase? But to respond to your original inquiry, you did not get a used phone, no need to be offended. You purchased an AT&T phone, as indicated by your receipt. If you do not want an AT&T phone, then you need to return it, unless it has been more than 14 days since you made your purchase.

It would appear that you purchased an AT&T phone. What does your receipt say? If it has been less than 14 days, return the device for a refund, and purchase the device you want.

If the receipt says AT&T, then you bought an AT&T phone...

Have you tried putting the SIM from your cellular carrier in the phone and activating it?

If you get an invalid SIM message when you do, then the phone is locked to AT&T. Only AT&T can unlock it.

If it's been less than 14 days since you bought it, you can return it for a refund.

If you buy a phone that is not specified as Unlocked on your receipt it will come with a SIM for the carrier it is associated with. Note that you can only buy unlocked phones directly from Apple. No other merchants sell unlocked phones.

Yes, if it works with a non-AT&T SIM then the phone is unlocked.

I’ve heard that if you pay full price for an iPhone at an Apple store it comes unlocked, even if is is sold as a carrier affiliated phone. If you had activated it on AT&T it might have locked it, but that is speculation.
