I got a phone from someone and they didn't delete their icloud account and I cant get into the phone and I cant get ahold of the person. what can I do? how can I reset the phone

Keep trying to get a hold of that person. You have an activation lock in place from the previous owner's Apple ID account. There is no way getting around this. You will not be able to use that phone with this information.

Take this Up with the Seller:
If you purchased this off of the Web (i.e. eBay) then contact the customer service and see what can be done for you on the seller's part. You would view the Terms & Conditions, and see if this is disobeyed on the seller's part in any manor whatsoever.
Next Time, Disassociate and Associate:
Just know that the next time you purchase an item in-person, be certain that the original owner logs out of the device from iCloud, disassociates from their Apple ID, allows you to log in to your Apple ID, associating it to your account. Next, see if you can view purchases associated to your Apple ID. And view your devices through iTunes, using another device of yours. Note that it may take upto 90 days for a device to be associate to another Apple ID.
