password encrypted
My old phone is encrypted and I have forgot the password .My phone is also broken so I cannot get into it and I now have a new phone which I want to back up from the old one??

If your old iPhone is broken AND if you do not have a backup of its content, you have only two choices:
Have your old iPhone repaired, so that you can back it up;
or
Use you new iPhone starting from scratch.

EDIT: Since you forgot your old iPhone passcode, even if you fix it you won't be able to recover the data if you don't have a backup.
