Setting up new phone

I’m setting up my moms phone but since we are on the same iCloud all of my pictures are being transferred to her new phone

It is usually not a good idea to share an Apple ID -- for the reason you've already seen, but also because anything else (Contacts, Notes, Reminders, iCloud Drive, etc) synced to iCloud will also merge to all devices. Each person can have their own Apple ID and still share selected things by using Family Sharing. See: Family Sharing - Apple

If you insist on using the same Apple ID and want to prevent the Photos issue (and only the Photos issue), when you set up her phone, don't turn on iCloud Photos. See: Set up and use iCloud Photos - Apple Support
