Is it possible to access a iPhone 5 if I do not have the iCloud email address and password?

Is this your phone? That is, did you purchase it new directly from Apple or got it used from another third-party source? Is it activation locked?
I had purchased it through a third party”bell Canada” it was purchased for my son whom is now deceased and I do not know what his email and password was.. what can I do?...I was planning on giving the phone to my daughter...
