Only the person who set up the activation lock can remove it. If you do not know who that is, which it sounds like you wont, then the phone is useless to you. Return it for a refund.

Apple generally doesn't unlock secondhand iPhones. Go back to the store and ask them to contact the previous owner or give you a refund.
