This sort of situation occurs with activation lock. Almost no one having activation lock is able to remove it without Apple support’s help. This help can be obtained whether you purchased you device new or second hand. You will need to have your, or access to the original owner's (and enlist their help), purchase receipt for the device from an authorized Apple seller with the device’s serial number on it.
