You can transfer only if you have used space lesser than the new iPhone. And the new device is on same or higher iOS version than the old device.

Old iphone says that I use 40GB out of the 256GB, so less

And yes I have the latest OS Inselland.

But still receiving a message that the memory isn't sufficient.

Is there some hidden Memory?
