I was given this Ipod by someone who found it.................and I have had it for over 3years now and not used it. How can i find out if I can use it

If it's a Gen 5 or Gen 6 IPod. You will not be able to get past Activation Lock. See: Activation Lock for iPhone, iPad, and iPod touch - Apple Support

If it does have a flashlight, then it is an earlier model that doesn't have Activation Lock. If so come back here and ask how to reset it.
