I recently dropped an old phone that has photos on it but I have a backup all the programs I could find were actually finding the photos and videos but I needed to pay to use it is there a free way?
can apple do this because I would trust them more with this than some sketching program on the internet that requires a subscription.
Any help would be appreciated.

You need to distinguish between iCloud synced photos and backed up photos. Log in to https://icloud.com and click on Photos. Do you see them? If so you synced them to iCloud, and you can just download them from that website. Also, if they are there they will not be in the backup, as that would be redundant.
If you backed up to iCloud, rather than syncing, I know of only one program that can get them from the iCloud backup; it can be purchased from https://iphonebackupextractor.com. It is not cheap. If you have a backup on your computer there are a number of free backup extractor programs available for download.
If it's in an iCloud backup and they are not on www.icloud.com/photos even paid software isn't guaranteed. Instead you would need to restore that backup to an iOS device
Well is it considered an icloud back up if I just went on finder hit the phone and hit backup?

All of them work with an iTunes backup. I haven’t used one in a while, but a web search for “iphone backup extractor” should return quite a few hits.

I haven’t checked recently. Compare prices. I’ve heard good things about imazing, never tried it, however.
