setting up my new iphone 12
My old iphone 7 plus is on a newer OS than my new 12. It says that it is up to date but because it is behind I can't restore my settings to the new phone!? Any suggestions on how to resolve?

yep.. it's cause you were running beta on the iPhone 7.
If you want to restore from a backup, you'll need to get the iPhone 12 on the same version by enrolling in beta.. then updating, then restoring from your backup
